We have a 3 storey property that we rent out the ground floor is a bar the 2 other floors are not used.When we rented it out my solicitor made 2 contracts 1 commercial and 1 as a vivienda. The tenants have asked can we lower the rent on the vivienda we have agreed to do this.As we will have to make a new contract would it be possible to make 1 contract as a commercial building (the building is insured as a commercial building) I am worried that the tenants are going to try and get out of the vivienda contract and only pay the contract on the bar and because of access issues and that fact that all the utilities are connected on the property it would be almost impossible for us to rent out the vivienda separately.

Dear Jayne,
I believe you cannot do this because you already have a standing agreement and it is a dwelling.
The new amended Tenancy agreement would have to be for a dwelling.
You only have to add a one-page annex really, there's no need to rewrite again the whole tenancy contract.
