Hello, i just need some clariiaction on what i can do. The house i live in is owned by myself and wife, and also her parents. We all have a 25% share of the property. We all live together and have done so for the past 20 years. Now my wife and I, and our 2 children 21 and 17 want to move back to the UK, so we want to sell the house in spain to have the money to buy one in the UK. The problem is that the inlaws do not want to sell or move from this house here in spain. What are my options please?
Hello Jo,
The property ownership can only be dissolved through a sale of percentages, as dissolution only takes place when there are two owners and one wants to step out. Partial dissolutions do not exist, but percentage sales that the tax office will later claim. The costs involved are the 7% transfer tax, lawyer, Notary and Land Registry fees.
We can assist in the process so please feel free to send us more information about the case through our website´s contact form.
Regards,
