First off I want to take this opportunity to thank you for the sterling work you do on this and other forums.

Our mortgage with CAM bank reverted to capital repayment July last year.

We have fallen behind with our mortgage and are less than 90 days behind.

The first payment missed was the 18th of November, then we missed 18th December and then 18th of January.

From what I've read on this forum, the clock starts from the first missed payment date, therefore we are 75 days (including today) behind with our mortgage. We can now continue to service our mortgage, it will be a monumental struggle, but we do not want to loose the property.

We can make a payment today, which will leave us only two payments behind, and then continue to make payments on time, but we cannot afford to pay the total arrears(the remaining two months) in one lump sum.

Having corresponded with the bank, they have asked that we make one payment immediately, and have given us one month to pay the arrears. This we cannot afford!

What we can do is continue to pay from now, and either pay off the remaining balance over an agreed period of time such as 10 months, or ask the bank to give us an extra loan or add the remaining balance back to the mortgage.

The question we have is:

Can the the bank start repossession proceedings before the 90 days are up?

In other words, if we make a payment today, and then continue to make payments on time, will that stop repossession, even though we will always be two months behind?
