    Question Community Fees

    Can you please tell me if cuota is the same as surface area? We are now being billed for our community fees by surface area and not cuota, without a vote, is this legal?

    Dear Sir/Madam,

    Spain's Commonhold Law (aka Horizontal Property Division Act) rules in its art 9 that all communers will contribute in accordance to their own quota in the Community of Owners. This quota is mentioned in the Horizontal Division Deed and also in your own Title deed. This is the proportion of communal expenses which cannot be individualised and that each communer must shoulder in proportion to their assigned quota in the commonhold.

    ArtÃ*culo 9.

    1. Son obligaciones de cada propietario:

    e) Contribuir, con arreglo a la cuota de participación fijada en el tÃ*tulo o a lo especialmente establecido, a los gastos generales para el adecuado sostenimiento del inmueble, sus servicios, cargas y responsabilidades que no sean susceptibles de individualización.
