    How long, under spanish law, before a missing person is presumed dead?

    Dear Sir or Madam,

    It depends on the circumstances in which he dissapeared, it depends of his age etc.. Please be more specific in your query. Arts 181-197 of the SCC rule it and were amended by a new law paseed in 2000.

    5 years if he was > 75 y.o.

    10 years if he was < 75 y.o.

    There are many specialties depending on the circumstances on which the person dissapeared:

    3 months if he was involved in a notorious accident (plane crash or sunk ship)

    1 year if his life was in jeopardy, under serious risk.

    6 months if the remain of the plane or sunken boat cannot be found

    etc.
