    Default Nationality and Spainish citizenship for foreigners' child

    Hi,
    Me and my wife are Vietnamese and we are students in Spain (Madrid) for a year. We have legal student visa as well as NIE until we finish our courses at the university.
    My wife has just found out that she is pregnant and we would like to ask which nationality would our child to be granted? Is it possible if our child to be considered legally as a Spainish citizen, and also has Spainish residence permit?
    And do the child's parents are granted for Spainish residency by Spainish law?

    Hello Shanefinlan,

    Your baby will have Vietnamese Nationality, as Vietman recognizes as Vietnamese Nationals those children born to Vietnamese Nationals outside the country. Therefore, as your baby won´t be regarded stateless, he will be born Vietnamese and will hold the same residency status as his/her parents. After one year holding the residency status, you will be able to apply for his/her Spanish Nationality as he/she has been born in Spain. You can check this information here.
