    Hello,

Theoretically this is possible; however you are going to encounter many difficulties. In any case the EU member ( your partners) will need to be resident in the town you plan to marry in. Also ask your partners to check with the civil registry and / or church, as the requirements could vary slightly.

    Hello,

As long as your future husband is a EU national and resident in Spain, you will be able to request your residence permit based on his. It is not necessary to prove that he is currently working.

Default illegal asian planning to marry a belgian

    hi mart,

i really need your advice. im an aupair, and i have a belgian bf and we are already 1yr and 1/2 with our relationship, we suppose to do wettelijk samenwonen before my contract ends which is APRIL 2013, but we change plan, because he dont want me to work in black but i need to save money to be able to go to school (nursing degree) so my diploma will be equivalent here.

then we plan not to so the samenwonen and wait for a year to get married, so i can save money while im working in black. will it be possible for us to marry? even i will be illegal? because my residence Id is only valid till April 2013.

hope you can help us with our situation.

    Hello Jmzie

Since you are a legal resident, your husband can apply for a Family Reunion permit (Autorización de residencia por Reagrupación Familiar), though this will involve him having to return to his home country. He needs to collect the visa, once the family reunion permit has been approved, from the corresponding Spanish consular office.

The Family Reunion permit application is filed by yourself as you are the Spanish resident requesting the Family reunion. The application can be filed personally at the Immigration office or online in the event you appoint a representative or hold a digital signature that allows you to deal with public entities electronically.

You can read the requirements of this type of permit application here.

There are certain financial requirements you need to meet, like for instance have a full time work contract.

There´s no option for your husband to apply from Spain, unless he meets the same requirements as you did when applying for Arraigo, that is to have been in Spain for three years in an irregular situation and have a work offer.

    Regards,
