    Default Part of the ceiling fell on me! and the landlord will not return my deposit.

    Hola.

    I moved into a rented property 10 weeks ago via a rental agency.

    The landlord promised to do structural work that was needed.

    He up to now has not done that work or cantacted me to say he intends to do it.

    Part of the ceiling in the en-suit fell on me whilst I was showering.

    The agent and the landlord were informed and I stated that we were moving out of the property before the rest of the ceiling came down and requested my deposit (1 months rent) be returned to me.

    The landlord has asked for pictures of the damage which I have sent him but he is refusing to return our deeposit.

    Is there anything I can do?

    We are moving out of the property in a few days time.

    Yes there are quite a few things you can do but they are all expensive (i.e. hiring lawyers) and you may find that on following these options they will defeat the whole purpose of recovering one months' deposit.

    Is it really worthwhile for you to be refunded the one month's security deposit?

    Are we talking of a luxury rental (> €3,500 pcm) or is it just a normal tenancy agreement?

    Maybe you should speak to a Consumer Agency which free of charge will add leverage to your -rightful- request.
