    Hi there,
    My girlfriend lives in the Uk and I live in Spain. She is 16 and im 21 and she wants to leave home to come and live with me in spain. Is there any law that constitutes that she can not do that?? Like some sort of age where you have to legally stay at home? I know that within the Uk you can leave home at the age 16 and was wondering whether this is any different in Spain?

    Dear Sir,

    Not an easy query.

    In Spain one becomes of legal age on attaining 18 years (Art. 315 SCC).

    However, Art 319 of the SCC allows > 16 y.o. < 18 y.o. to live independently so long as their parents/legal custodians allow them. This permission can however be revoked at any point in time before they reach 18 in which case they would have to go and live with their legal custodians.

    So basically, as long as you are sure her parents have consented in her living with you you will not have legal problems.

    If her parents do not offer their express agreement you may find yourself living with a minor and you may incur in legal responsibilities should they press charges against you.
