Nationality for New Born of a Student

Hi,

My legal status in spain is estudiante. Neither my wife or I are citizens of EU. My daughter was born in barcelona a few weeks ago.

I have read on this forum that the baby would be able to apply for Spanish Nationality after one year of residence, but for her to get the legal residence card, the parent must be a "legal resident".

I have read here that a student NIE only counts as a "estancia".

My Question: Am I a legal resident of Spain ? And therefore, can I apply for the "Autorización de residencia del hijo de residente legal nacido en España"
