Dear Madam,

You will need to obtain permission form the ConsejerĂ*a de EducaciĂłn y Ciencia de la Junta de AndalucĂ*a.

The premises chosen must fulfill the following requirements (art 13 Decree 149/2009):

• Minimum size of 120 m2
• It should have at least three rooms and a fourth room for multiple uses. Each one of them must have a minimum size of 30m2
• You will also need space for bathrooms (one for each room) and an additional one for the employees.
• You must have a playground of at least 75m2 for the toddlers
• The maximum number of toddlers is capped
• You will have to hire one specialist teacher for each room. i.e. three rooms = 3 teachers These teachers must be specially qualified to take care of small children. Not any teacher will do. The must have a specific degree.

Etc.

Once the Junta de Andalucia Education department grants you permission (Administrative Licence) you will also need to attain the Licence from Marbella's Town Hall. You will have to be registered both at the Tax office and Social Security.

You should examine Andalñucia's Decrees 109/1992 of 9th of June and Decree 149/2009 of 12th of May (http://www.juntadeandalucia.es/educacion/portal/com/bin/Contenidos/PSE/Infantil/normativa/decreto149_2009/1242369136127_boja_decreto149.pdf).
