View Full Version : Norwegian inheritance laws include my gifted house as part of the estate?

My late husband gifted me his house.
This was done according to spanish law, and the transfer tax was paid in full.
Now, two years later he has passed away.

He had a spanish will made up and notarized which should now be executed.

It declares how he wished to have his 'norwegian estate' divided. A large portion would have come to me.

However, I have received a letter from the legal heirs in Norway which states that the house I was gifted and which is in my name here in spain, will belong to the estate which is to be divided 3/4 for the children and 1/4 for the spouse. Yes he was my second husband.

The "estate" the lawyer claims would include my house according to testementary disposition laws which state that when a man is dying, gifted assets are then included in the estate to be divided according to national inheritance laws.

Please advise if this is true. Also is it realistic that they would be able to get a court order from a spanish judge to re-posess my house into the estate?
