Hello.

I am trying to establish whether or not it is allowed under community law for a community's unpaid President to operate a property management business within said community.

I ask because I believe there to be a conflict of interest with our President favouring his clients within our community.

When I was policeman, we were not allowed to carry out any paid work outside of the job for this very reason.

Does this apply to community law, and if so, where would I find this rule?

Thanks

Patricia

Hello DanP

There is nothing eatablished on the current Law of Horizontal property (http://noticias.juridicas.com/base_datos/Privado/lph.html) in this regard, that is, that the President is allowed to offer his services ( from his own company ) to the CO and make business with it. However, the CO can establish their own rules and get the matter to be voted on a GM, so whatever is agreed by the majority will have to be respected. It is certainly an issue of conflict of interest so the Ethics and norms of good behaviour should rule in this decision, in lack of any specific regulation.
