i am told by my communidad in mallorca that they are going to denouce me for renting my apt out what is the procedure for this and how can they prove it what will happen if they can prove it thank you iam very worried

Hello lord alfred

Renting your apartment out is not illegal. If you are not declaring the rental to the tax office, then you can be fined. Perhaps you should start submitting your form 210 on a regular basis to avoid having problems with the tax man.

I have not taken into account that your property is located in Mallorca. Quoting an article (http://belegal.com/articles/showArticle/buying-off-plan-property-in-spain) written by the excellent lawyer Raymundo Larrain Nesbitt (http://es.linkedin.com/pub/raymundo-larra%C3%ADn-nesbitt/5/492/830), the Balearic Islands seem to have their own regulations when it comes to renting out your property.


If you are Considering Buy-to-Let, Make Sure the Local Laws Allow This

If you are buying with a view to rent the property out, either as short or long-term, make sure the region of Spain in which you are buying allows for this. Some regions, i.e. Balearic Islands, have stringent regulations whereby a special licence is required to rent. Failure to comply will result in the Town Hall fining you. Disgruntled neighbours always make apt whistle-blowers, so be warned. Other regions in Spain, such as AndalucÃ*a, do not require letting licences but do have their own regulation in place on letting out property. i.e. Decree 218/2005. And as a final word of caution, unless your property is in a prime location, do not rely on the let to offset the mortgage repayments.


Therefore, I recommend that you contact a local lawyer or gestoria to sort out your rental licence.
