pre contract rental in mallorca

i have signed a pre-contrat to reserve an apartment for rent (contrato de reserva de alquiler) and paid deposit to the owner. After 3 days and some life circumstances, I have contacted the owner and explained to him that I would like to cancel it. The owner said he won´t return the deposit back of 800e for the loss I have caused him.
Can I received my deposit back or does he has the right to keep it?

It is important to check the rental contract conditions and rental start date.

However, if the property was only taken off the market for 3 days, keeping a 800 € deposit wouldn´t be justified in principle.

We recommend you to show the rental contract to an expert lawyer that can confirm your landlord´s claim has no legal grounds.
