Hi we signed a rent to buy contract here in Spain 3 years ago. We paid a deposit also. 3 months after signing the contract the seller sold it to someone else but we could still stay in the property. Now our contract has run out and we were going to buy it but when we had a valuation done it came back 50,000€ less than what we agreed on which meant we couldn't get a mortgage. My question is when we originally signed the contract , it said in the contract the seller wasn't allowed to sell the property but he did. Isn't that breach of contract? Now we can't buy the property and the original owner breached the contract aren't we entitled to our initial deposit paid and also in Spanish law aren't we entitled to buy the property for the price the original seller sold it for? I would love some advice on this
