    Default Burst water pipe

    We signed a long term contract for a flat eight months ago. After a few months it became apparent that the construction of the flat is not very good. We have had several issues with leaks, short circuits, lights falling from the ceiling, etc. The landlord is also the owner of the company that built the building.

    While we were on vacation a pipe in our flat burst and leaked into our flat and the flat below. The landlord is now claiming that we are liable for any damages.

    Is this in accordance with Spanish Law? Are we liable in Spain for a defective pipe in a flat we don't own?

    John,

    Spanish law says that, in the event of damage caused to the property, the tenant can be responsible to up to half a months rent. However, this is not wear and tear, which is the responsibility of the tenant, but a defect that is out of your control. Also, this is sounds more like damage that should be covered by the property insurance. In any event, this is a claim that is to be covered by the landlord, an opinion that most Spanish lawyers will share.

    I was told about a standard tenancy template which is available through Spains government website & tobacconists. Can anyone point me in the right direction??
