    Default At loss with a situation in Mallorca

    Hi everyone
    This is our first post in here
    My brother bought a flat in cala pi Mallorca last summer
    The flat is one of 12 constructed
    Only 4 out of 12 flats have been sold
    It all went ok until 2 weeks ago as the water pressure pump and pool filter stopped working
    The developer didn't pay the bill for the communal areas electricty and as a result we do not have water on the second floor because the pump feeds from the meter on the communal part and the electrical meter has been removed ( confiscated )
    We have tried to get in touch with the developer but he is not answering any calls
    Could you please enlighten us on the procedure as the flat is effectively unusable

    Hi,
    The communal areas bills must be paid by the "Comunidad de Propietarios", that is, a separate legal entity owned by the co-owners. Each co-owner has the obligation to contribute to the "comunidad de propietarios" according to their participation as co-owners (in your case, most probably a 1/12 approximately).
    If the "comunidad de Propietarios" does not have enough funds to pay the bills, each co-owner will have the obligation to contribute a extraordinary sum of money. After that, and if one of the co-owners (in this case, the developer) does not pay its contribution, the "comunidad de propietarios" will have to sue the developer.
