Hello, I would like to clarify if according to the Ley de Costas is it still possible to sell an apartment?
It was originally purchased in 1976, before this law was put into practice in the 1980's. The building is a small block of 6 flats and is quite far back from the coast, on the sand dunes. The owner has never received any letter of notification about it being in the coastal delineation.

The Ley de Costas is not applied retrospectively. However, in certain circumstances some properties may be affected, as the land they are built on may be declared of public interest and expropriated, which means certain degree of retrospectivity is in practice being applied. If you can read Spanish, this comment describes it well.

I recommend that you submit an enquiry at the Town Hall to find out the current legal situation of your property. Alternatively, you can request a valuation from and independent valuer (e.g. Tinsa), which will most likely surface any legal problems that may affect the property.
