Our father died in 2000 leaving an apartment in Spain in his (Scottish) will to myself and 2 siblings to be evenly split. Due to other deaths and problems including the Scottish solicitors not being overly helpful, this was not resolved at the time. Our brother who lived in Spain at that time moved into the apartment (2001) and paid outstanding bills and has lived there since.
My sister is now trying to find out if we still have any claim for the property. There were quite a few disputes about other property in the UK and my brother is adamant he does not want to sell the Spanish property and has said we can all use it but this will never happen because of the disputes.
Would we still have any claim or is there a time limit to contend this especially as our brother has been living there and paying the rates etc for over ten years?
