    Default Illegal extension

    Hello there. On my urbanisation there is a 10 year old house to which 5 years ago an illegal extension was added. The house is now for sale it having changed hands once since the extension was built. My question is as it is now 5 years since the extension was built can this now be legalised although the sq.mts of the house are too big for the size of the plot ?

    Welcome to the belegal forum.

    Initially, the built extension can be legalized after 4 years, however, in the event that the land was considered of special protection, this would not apply.

    Our advice is that the interested party appoints a solicitor to make a legal search on the situation of the land and process the legalization of the new built area in public deeds. The interested party can also approach the Town Planning department at the town hall ( Urbanismo ), so they confirm the current situation of the land and indicate if it is in a special protection area and provide with solutions to legalize and amend the ( possible ) current objections.
