    Question Arraigo

    Met a guy in estepona, I found out that he's been here in Spain illegally for more than 3 yrs now and advised him to apply for arraigo but he said he can't because he has been arrested before been jailed for a day because he doesn't have the necessary documents to stay here and somebody advised him that there's no way he can be legalized here due to his police record! Please enlighten us, thank you!

    Hello,

    It is possible to apply for perrmiso de residencia por arraigo social even if you have an " orden de expulsion" ( deportation order ) provided you meet with all the requirements to apply for arraigo and that the only reason for being jailed and arrested was the fact that he was in an irregular situation, If the reasons are different to that, he will need to go back to his country and apply for residency through the ordinary means.
