    Question joint property onwership

    Hi I own a house in South Spain along with my brother as our parents died. My brother lives in the property but i would like to sell it. Can I force him to sell or does he have to willingly sign documents?

    Hello,

    Yes, you can actually force him to sell the property, as you are not obliged to remain in joint ownership; however this involves a court action, as it will be a judge authorizing the sale of the house at Public auction. We always recommend to try and negotiate with your co-owner, as when a property is taken to an auction, both parties are at a loss, as the value at the auction of a house is dramatically dropped in most cases.
