Permanent residence

Hi, Please any advice would be nice. Our situation is next: Im finnish and my husband is nigerian. We have been married for 5 years now. And we have 2 kids. He have spanish residence 5 years and it will expire this December. We are living is Spain. Before we apply the renewal I would like to find out something.

I red about Permanent residence for non-EU family members and in my opinion he could apply it? But he went to ofician de extranjerias and they gave him info that he will just renew his status (eu members family member and he will get 5 years again).
