View Full Version : Do we need a NIE Number if we own a property through a company?

Together with other colleagues I purchased a small apartment in Spain. Because there were 12 partners we registered ourselves as a company with Companies House and submit yearly accounts to them. This is a non profit company and we contribute to the upkeep of the property. As there are 12 of us do we need an NIE number as none of us individually own the property?

Dear Ken

You don’t specify if you have a UK or a Spanish Limited Company but in any event you will, at some point, require an NIE number.

For the UK company the Tax Office is now requesting that owners are disclosed to the Spanish Tax Office to avoid the company being taxed for 3% of the rateable value. This is annual tax declaration and it requires that you are all residents of a country with an exchange of information agreement in place with Spain.

For a Spanish Limited Company it may happen that the shares are sold, or that you become directors or even that the company is one day dissolved and the shares adjudicated into fractions of direct property ownership.
