Hello
I have question which have answered many times with different answers and now I'm confused.
I have a Spanish wife and after 18 months of legal married and a baby boy between us, we start to have too much problems and she want to divorce, and want to know if I'm going to loose my residents card or not?
Thanks in advance

Hello Pateh,

You will not lose your residence card ( the right to it ), however, once the divorce process has ended, you must notify the immigration office about your new family circumstances. As you have a son who lives in Spain, you will just need to show the authorities that you have the right to visit your son or even his joint custody if that was the case( filing the corresponding divorce settlement approved by the courts ), so your card will not be modified to regimen general and remain under Regimen Comunitario, keeping its current validity.

If you wish to contact me personally to discuss your case in detail, you can find my contact details below (in my signature).

Regards,
