Hi all,

I rent out a commercial space (restaurant) and the tennant has not paid the rent for the last two months, the electricity for three months, and the community charge. I want to terminate the contract but we share the same lawer. Do I (or him) need to change lawer and what is the first legal step I need to take.

Hello Peter27,

Well, it is advisable to change lawyer as there are no guarantees of the impartiality of the current one, as he/she has already represented both parties.

The first step would be to send a registered letter ( Burofax ) to the tenant requesting the payment of the debt, warning him that if he fails to do it you will resolve the rental contract and take the corresponfing legal actions to claim the debts and process the eviction.

The most convenient thing is to appoint a solicitor that deals with the whole process from the beginning.
